“The premises shall install and maintain
a comprehensive CCTV system as per the minimum requirements of a
Metropolitan Police Crime Prevention Officer. All entry and exit
points will be covered enabling frontal identification of every
person entering in any light condition. The CCTV system shall
continually record whilst the premises is open for licensable
activities and during all times when customers remain on the
premises. All recordings shall be stored for a minimum period of 31
days with date and time stamping. Recordings shall be made
available to within 24 hours upon the request of Police or
authorised officer throughout the preceding 31
day period.
A staff member from the premises who is
conversant with the operation of the CCTV system shall be on the
premises at all times when the premises are open to the public.
This staff member shall be able to show Police recent data or
footage with the absolute minimum of delay when
requested”.
Replace and amend condition 14 as follows:
“A sound limiting device shall be
installed to control all amplified sound generated on the premises.
The device shall be approved by and set to the Council’s
satisfaction and thereafter maintained for the duration of its
use”.
Additional conditions to be added to the
premises licence:
1.
The premises will operate a Challenge 25 scheme at the premises.
The only acceptable form of identification will be recognised
photographic identification cards, such as driving licences and
passports.
2.
An incident log shall be kept at the premises, and made available
on request to an authorised officer of the City Council or the
Police, which will record the following:
(a) all crimes reported to the
venue
(b) all ejections of patrons
(c) any complaints received
(d) any incidents of disorder
(e) seizures of drugs or offensive
weapons
(f) any faults in the CCTV system or
searching equipment or scanning equipment
(g) any refusal of the sale of
alcohol
(h) any visit by a relevant authority
or emergency service.
3.
Premises to operate a zero tolerance policy to drugs and comply
with the Hackney Police/Council Community Safety Unit Drugs and
Weapons policy where appropriate.
4.
The premises will display prominent signage by every entrance and
exit explaining/requesting customers to leave the premises quietly
and respect local residents.
5.
An adequate and appropriate supply of first aid equipment and
materials shall be available on the premises.
6.
The premises licence holder shall ensure that all staff will
undertake training in their responsibilities including upholding
the four objectives set out in the Licensing Act 2003. Records will
be kept of training and refresher training which will take place
annually.
7.
All exit routes shall be kept unobstructed, with non-slippery and
even surfaces, free of trip hazards and clearly identified.
8.
All exits doors shall be maintained easily operable without the use
of a key, card, code or similar means.
9.
Exit doors shall be regularly checked to ensure that they function
satisfactorily, and a record of the check shall be kept.
10.The Licence Holder shall provide and maintain a
dedicated telephone number of the Designated Premises Supervisor.
This shall be provided to the Licensing Authority, Police and local
Residents Associations. The Licence Holder shall ensure that any
changes to these details are sent to these parties within seven
days.
11.The Licensee shall ensure that all staff are
fully trained and made aware of the legal requirement of businesses
to comply with their duty of care as regards the disposal of waste
produced from the business premises. The procedure for handling and
preparing for disposal of the waste shall be in writing and
displayed in a prominent place where it can be referred to at all
times by staff.
12.The Licensee shall ensure that any contract for
general and recyclable waste disposal shall be appropriate in size
to the amount of waste produced by the business. The Licensee shall
maintain an adequate supply of waste receptacles provided by his
registered waste carrier (refuse sacks or commercial waste bins) in
order to ensure all refuse emanating from the business is always
presented for collection by his waste carrier and shall not use any
plain black or unidentifiable refuse sacks or any other
unidentifiable or unmarked waste receptacles.
13.Amplified sound (live music or recorded music)
on the premises shall be played at such a level so as not to cause
nuisance to any un-associated noise sensitive premises.
14.A sound limiting device within the premises
shall be installed to control all regulated entertainment generated
in the premises. The device shall be approved by and set to the
Council’s satisfaction so to ensure noise nuisance is not
caused in any associated residential premises.
15.No new entry on Friday and Saturdays after
02:00.
Reasons for the
decision
The application to vary this premises licence
has been approved as members of the Licensing Sub-committee were
satisfied that the licensing objectives would not be
undermined.
The Sub-committee noted that the Environmental
Protection Service agreed conditions with the Premises Licence
Holder and withdrew their objection. It was also noted that the
Metropolitan Police Service (“the Police”) withdrew
their objection. The Sub-committee took into consideration that the
Licensing Authority maintained their objection to the application
on the grounds of crime and disorder and public nuisance. It was
noted that there were no objections from local residents.
The Sub-committee took into account
representations made by the Premises Licence Holder’s legal
representative about the premises being a community lead music,
cabaret and entertainment venue which is cultural lead. The
Premises Licence Holder contended that the Police had given their
support to the application.
The Sub-committee took into consideration
representations made by the Licensing Authority that the premises
is long established and in a prominent location in the Shoreditch
area. The Licensing Authority made representations that there had
been recent research confirming the cumulative impact in the area.
A recent site visit was conducted and noted that there had been
significant cosmetic works carried out at the premises such as wood
panelling, a sound limiter and the premises was operating to a high
standard.
The Sub-committee noted that the Licensing
Authority’s concerns were limited to the cumulative impact in
the area. The Sub-committee noted that the Licensing Authority
raised no objection to the conditions being amended.
The Sub-committee took into consideration the
representations made on behalf of the Music Venues Trust who
confirmed that the premises was a grassroots music venue. There was
an established management for a number of years and they have a
robust approach to operating the premises, and the processes and
procedures for operating the premises are reviewed regularly.
The Sub-committee took into consideration that
the premises support live music and are diverse in what they offer.
The Sub-committee noted that there were no concerns from the
Environmental Protection Service and the Metropolitan Police
Service.
The Sub-committee took into consideration that
there were concerns about the intensity of live music after 02:00.
The Sub-committee noted that the live music events would be
controlled within enclosed rooms.
The Sub-committee were satisfied that the
Premises Licence Holder agreed to a “no new entry”
condition which will help with dispersal from the premises.
The Sub-committee took into consideration that
the premises was well run and had operated a number of temporary
events between 2023 and 2024 without incident. The Sub-committee
also took into consideration that the premises had already been
operating beyond core hours (Policy LP3) without any complaints or
incidents. The Sub-committee took into account that the premises
had a robust dispersal policy and the Premises Licence Holder
demonstrated that they were a responsible operator.
Having taken all of the above factors into
consideration the Sub-committee was satisfied that by granting this
variation to the premises licence that the licensing objectives
would continue to be promoted.
