Counter Notice (Temporary Event Notice for
19th July 2025): Kingsland Nursery, 3 Birkbeck Mews, London, E8 2LE
The Licensing sub-committee, in considering
this decision from the information presented to it within the
report and at the hearing, has determined that having regard to the
promotion of the licensing objectives:

The prevention of crime and disorder;
·
Public safety;
·
Prevention of public nuisance; and
·
The protection of children from harm
And in particular upon consideration of the
objection notices given by the Metropolitan Police and the
Environmental Protection Service, is satisfied that the proposed
event would undermine the licensing objectives. Therefore, the
Sub-Committee has decided to serve a counter notice.
Reasons for the
decision
The Licensing Sub-Committee took into
consideration the objections received from the Metropolitan Police
(“the Police”) and the Environmental Protection Service
to the Temporary Event Notice for the period on 19/07/2025
commencing 12:00 and ending on 19/07/2025 at 21:00.
The Sub-Committee took into account the Police
and the Environmental Protection Service concerns about public
nuisance that would undermine the licensing objectives. The
Sub-Committee took into account that on 3rd July 2025 a Noise
Abatement Notice was issued under the Environmental Protection Act
1990.
The Sub-Committee took into consideration the
Premises Users that a number of complaints had been received during
a previous event. The Sub-Committee took into account that the
premises are situated near to residential dwellings.
The Sub-Committee felt that 150 people is a
significant number at a silent disco. Furthermore, even if there
was a reduction in the number of people this would still create a
disturbance and have a serious impact on the residential
properties. The Sub-Committee felt this is a large daytime event
with no clear controls in place that will have an impact on the
area
The Sub-Committee felt the Police and the
Environmental Protection Service evidence was strong on why this
temporary event should not take place. The Sub-Committee therefore
considered that allowing this event to take place in accordance
with the Temporary Event Notice would undermine the licensing
objectives. The Sub-Committee decided that it was necessary and
proportionate to issue a counter notice.
