Application for a
Premises Licence – Coffee Junction, 42 Provost Street,
London, N1 7SU - APPROVAL

RESOLVED:
 
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:
 
· 
The prevention of crime and disorder
· 
Public safety
· 
Prevention of public nuisance
· 
The protection of children from harm
 
The application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of
the report.

· 
Condition 12 shall be amended and read as follows:
 
"All instances of crime or disorder to be
reported by the designated premises supervisor or responsible
member of staff to the Police in the first instance".
 
And the following conditions will be added to
the premises licence:
 
 
· 
No vertical drinking is permitted.
 
· 
Off-sales are only permitted to be served to seated customers in
the designated outside area outside the studio near the smoking
area.
 
· 
No glasses or glass containers are permitted to be taken outside of
the premises. 
 
· 
There shall be no more than 11 smokers outside the studio at any
one time.
 
· 
The number of persons (including staff and entertainers) allowed at
the premises shall not exceed 120.
 
· 
The Premises Licence Holder shall organise and publicise a meeting
(online and/or in person) for local residents to discuss the
operation of the premises at least every 6 months.
 
· 
The Premises Licence Holder shall maintain a dedicated telephone
number and email address that must be available at all times. These
contact details shall be included on any website of the premises
and on display at the premises.
 
Reasons for the
decision
 
The application for a premises licence has
been approved as members of the Licensing Sub-Committee were
satisfied that the licensing objectives would not be
undermined. 
 
The Sub-Committee took into consideration that
there were 2 objections from Other Persons (local residents), and
the Police and the Environmental Enforcement Service both withdrew
their representations before the hearing after agreeing conditions
with the Applicant. The Sub-Committee took into account that the
Licensing Authority withdrew their representations before the
hearing after agreeing a condition and amended hours with the
Applicant.  It was noted that no other
Responsible Authorities made representations.
 
The Sub-Committee heard representations from
the Applicant’s Agent that the Applicant obtained a
15 year lease in 2022, and only recently
applied for an alcohol licence. The premises is a family run business they do not intend to open
late. The Applicant and their staff keep both inside and outside
the premises clean.
 
The Sub-Committee heard that the staff clear
litter outside the premises particularly at the weekends. It was
noted there is a lot of take away litter regularly in the area. The
Sub-Committee heard that the tables and chairs in the outside area
are moveable. The tables and chairs are taken in at the end of the
day, and brought out in the morning.
 
The Sub-Committee took into account the
Applicant’s representations that they do not intend to hold
private parties. They want to close the cafe at 18:00. The
Applicant agreed to inform local residents if they hold private
events with music. The Sub-Committee noted that the premises have
no delivery service; they only serve customers inside the premises
and do take away.
 
The Sub-Committee took into consideration that
the local residents have concerns that consumption of alcohol will
lead to rowdy behaviour from customers. It was noted that the
premises is on the fridge of
Shoreditch.
The Sub-Committee noted that the local
residents made representations that the cafe premises operate in
the daytime until 18:00 without any issues. The premises currently
do not look like a bar. However, there are concerns about public
nuisance once alcohol consumption commences.
 
The Sub-Committee took into account that the
local residents maintained their objections after hearing from the
Applicant and their representative because they still had concerns
about how the premises will transform once they start selling
alcohol and how it will impact the local residents in the area.
 
The Sub-Committee took into consideration that
the Applicant had reduced the proposed hours and there was no
change to the existing opening hours.
 
The Sub-Committee took into consideration that
the Applicant had reduced their hours, they agreed conditions with
the Responsible Authorities. The Sub-Committee was satisfied that
any element of public nuisance has been mitigated.
 
The Sub-Committee were reassured about the
events, and the operation of the premises going forward. The
Sub-Committee was satisfied that the application would not
undermine the licensing objectives and would not add to the
cumulative impact. 
 
The Sub-Committee felt reassured that under
condition 16 the Applicant had agreed with the Licensing Authority
that alcohol will be served to seated customers, and there will be
no vertical drinking. The Sub-Committee took into consideration
that the premises will close at 19:00 which mitigates any negative
impact on local residents.
 
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting the
premises licence the licensing objectives would not be
undermined.

Informative
 
1. 
The Premises Licence Holder is reminded that "A boards" are
considered a highway obstruction and as a result are banned from
the public highway. This is to maintain accessible pavements for
everyone, including people with disabilities and those with
pushchairs.
 
2. 
The Premises Licence Holder is advised to inform local residents
and anyone that is likely to be affected when they are holding
events.
 
3. 
The Premises Licence Holder is further reminded of the need to
operate the premises according to any current planning permission
relating to its use class, conditions and to regularise the hours
as required.
 
4. 
It also should be noted for the public record that the Local
Planning Authority should draw no inference or be bound by this
decision with regard to any future planning application which may
be made.
 
5. 
The Premises Licence Holder is encouraged to engage in meaningful
dialogue with the local residents to resolve any issues relating to
the premises, and for the Premises Licence holder to play their
part in reducing any impacts of noise emanating from the
premises.
 
6. 
The Premises Licence Holder is strongly encouraged to use
sustainable cutlery, plates, cups, food containers, and recyclable
disposable materials to avoid using single-use plastic disposable
items.
