Decision

RESOLVED:

3.1  To consider and have regard to the evidence supporting the
  implementation of Selective and Additional HMO Licensing schemes as
  detailed in the Property Licensing Schemes Implementation Evidence
  Report (Appendix 1).

  1. 2  To consider the outcome of the consultation process detailed in the
    Consultation Report (Appendix 2), the representations received and the Council’s consideration and response to these representations (Appendix 3).

  2. 3  To note that the document to support undertaking this public consultation
    (consultation evidence pack) (Appendix 4) and Housing Conditions and Stressors Report (Appendix 5) highlight the scale of problems arising from poorly managed private rented properties, identifies the objectives that the proposed licensing schemes would help the Council achieve and alternatives to licensing which have been considered.

  3. 4  Upon consideration of the matters at 3.1 and 3.2 above and using its
    powers under section 56 of the Housing Act 2004, agree to designate a new Additional Licensing area of the whole of the London borough of Hackney as delineated and edged purple on the map in the draft designation in Appendix 6 to come into force on 01 May 2026 for a five-year period.
  4. 5  Upon consideration of the matters at 3.1 and 3.2 above and using its
    powers under section 80 of the Housing Act 2004, to designate a new Selective Licensing area in the seventeen ward areas of Brownswood, Cazenove, Clissold, Dalston, De Beauvoir, Hackney Central, Hackney Downs, Hackney Wick, Homerton, King's Park, Lea Bridge, London Fields, Shacklewell, Springfield, Stamford Hill West, Stoke Newington, and Victoria as delineated and highlighted purple on the map in the draft designation in Appendix 7 to come into force on 01 May 2026 for a five-year period.
  5. 6  Approve the proposed licensing scheme objectives as set out in
    Appendix 8.

  6. 7  Approve proposed additional HMO licence conditions set out in
    Appendix 9.

  7. 8  Approve the proposed selective licence conditions set out in Appendix
    10.

  8. 9  Approve the proposed property licensing fee structure for licence
    applications made under the additional and selective licensing schemes detailed in Appendix 11.
  9. 10  Consider and have regard to the result of the Equalities Impact
    Assessment in Appendix 12.
  10. 11  Subject to Cabinet agreeing 3.4 and 3.5, delegate the authority to the
    Director of Housing Strategy & Homelessness to issue the required statutory notifications in relation to the designations and, in consultation with the Portfolio Lead Member for Private Rented Sector and Housing Affordability, to ensure compliance in all respects with all relevant procedures and formalities applicable to authorisation of the scheme; to keep the proposed scheme under review during the designation lifetime and agree any changes to the proposed implementation and delivery, including administration, fees and conditions as is necessary for the effective administration of the scheme, and give all necessary statutory notifications.
  11. 12  Agree to delegate to the Director of Housing Strategy & Homelessness
    to approve the carry forward of any surplus or deficits to the established ring-fenced trading account as and when necessary, subject to consultation with the Chief Finance Officer.
