The decision
 
The Licensing Sub-Committee, in considering
this decision from the information presented to them within the
report and at the hearing and having regard to the promotion of the
licensing objectives:

been approved in accordance with the Council’s Statement of
Licensing and the proposed conditions set out in paragraph 8.1 of
the report.

Reasons for the
decision
 
The application for a premises licence has
been approved, as members of the Licensing Sub-Committee were
satisfied that the licensing objectives would not be undermined in
the Shoreditch Special Policy Area (“Shoreditch
SPA”).
 
The Sub-Committee took into consideration the
Licensing Authority made representations on the grounds of the
prevention of public nuisance.
 
The Sub-Committee noted that the Environmental
Enforcement Service, and the Environmental Protection Service made
representations, and proposed conditions set out at paragraph 8.1
of the report, which have been agreed by the Applicant. The
Sub-Committee noted there were no objections from the other
Responsible Authorities including the Police.
 
The Sub-Committee took into consideration that
4 Other Persons (local residents) made written representations
objecting to the application on the grounds of the four licensing
objectives.
 
The Sub-Committee noted that the Applicants
held a number of temporary events from June to November 2025.
 
The Sub-Committee felt that the conditions the
Applicants agreed will mitigate the impact on the area, and the
local residents, and that it will not add to the cumulative impact
in the Shoreditch SPA.
 
The Sub-Committee felt that the off-sales
needed to be removed from the application because it reassured the
Sub-Committee that the premises will not contribute to the
cumulative impact of the area, and taking into consideration future
operators.
 
The Sub-Committee noted that the acoustic
concerns were dealt with by the Environmental Protection condition
that the Applicants agreed to. There were concerns about the number
of people congregating outside which have been addressed by the
conditions.
 
The Sub-Committee heard the concerns of the
local residents which included noise nuisance, a lack of sound
proofing, the capacity of the premises, and there were concerns
about the narrow pavement that could be blocked. They were
concerned about the premises having a basement and about losing the
premises as a shop in the area. The Sub-Committee heard
representations from the local residents that there was no kitchen
and no planning permission in place for what the Applicants were
proposing. The Sub-Committee heard the concerns about two other
pubs which are very close together, and about people loitering
outside late at night and causing a disturbance.
 
The Sub-Committee heard the concerns of the
local residents about the description of the ground and first floor
as there is no staircase in the premises. It was noted that a fire
risk assessment is needed. They were concerned that the area will
lose the use of a shop as an amenity in the area. The local
residents were concerned about the future operators of the premises
and how they will deal with any licence and conditions that may be
granted,
 
The Sub-Committee felt that the evidence
provided by local residents was strong and persuasive about their
concerns in the area. The Sub-Committee took into consideration
that the local residents were not convinced that the premises would
not add to the cumulative impact of the Shoreditch SPA.
 
The Sub-Committee took into consideration
representations from the Applicants that the premises operates as a coffee shop and in the evening they
will provide a relaxing area with no loud music. The Applicants
made representations that there was a need for what they will be
offering for the community in the Shoreditch area. The
Sub-Committee heard that the Applicants took into consideration the
number of objections raised and were willing to work with local
residents to overcome their concerns.
 
The Applicants made representations that in
recent months there have been events with no loud music and no
drinking outside after 22:00. The Sub-Committee noted that the
Applicants are experienced operators who have
been operating in the area for a number of
years, and are very familiar with the nature of the area.
 
The Sub-Committee took into account that the
Licensing Authority had concerns about the capacity of the premises
which was not clear on the application for both floors. Also there
were concerns that alcohol was not to be provided as ancillary to
food.
 
The Sub-Committee after hearing the
representations noted that there was no pavement licence and that
the Applicants needed to make an application.
The site plan needed to be amended to show the
correct floors in the premises. The Sub-Committee took into
consideration that the Applicants agreed to the following
conditions: alcohol being served to seated customers, no alcohol
outside after 22:00, and any outside furniture and benches to be
removed from 22:00 from the outside area. The Applicants agreed to
the number of smokers being limited to four in the outside
area.
 
Having taken all of the above factors into
consideration the Sub-Committee was satisfied that by granting this
premises licence, the licensing objectives would not be undermined
in the Shoreditch SPA.

Informative
 
1. 
The Premises Licence Holder is advised to obtain a tables and
chairs licence to use the outside area of the premises.

The Premises Licence Holder is advised to submit a Fire Risk
Assessment to the Licensing Authority.

The Premises Licence Holder is advised to submit a Dispersal Policy
to the Licensing Authority.

The Premises Licence Holder is further reminded of the need to
operate the premises according to any current planning permission

The Premises Licence Holder is strongly encouraged to use

sustainable cutlery, plates, cups, food containers, and recyclable
disposable materials to avoid using single-use plastic disposable
