The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

The application to vary a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

At least 1 x SIA door staff will be on duty from 1600hrs until 30 minutes past the end of service. 14. Where a SIA door supervisor is on duty, bag searches will be required as a condition of entry to the building”.

·  Condition 15 shall be amended to read as follows: 

“Customers and guests will not be allowed to bring their own alcohol onto site, it will be confiscated by SIA door staff as a condition of entry”.

·  Condition 49 shall be amended to read as follows: 

     “There shall be a maximum of 242 customers at any one time”. 

·  Condition 32 shall be amended to read as follows: 

“ The Premises Licence Holder shall submit a written dispersal policy to the Licensing Authority and the Police. The dispersal policy shall be implemented at the premises. All staff shall be briefed on this dispersal policy. A copy of the policy shall be kept on the premises and shall be produced to a Police officer or other authorised officer upon request”.

And the following condition shall be added to the premises licence:

·  The Premises Licence holder shall maintain a dedicated contact telephone number and email address that must be available at all times to any person wishing to report concerns or make a complaint. These contact details shall be included on any website of the premises and on display at the premises.

Reasons for the decision

The application to vary this premises licence has been approved, as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined.

The Sub-Committee took into consideration that no response authorities objected to the application and eight Other Persons (local residents) maintained their objections.

The Sub-Committee having taken all representations into consideration felt that the Premises Licence Holder demonstrated that they are a responsible operator. However, the Premises Licence Holder needed to be mindful not to have customers congregating around the premises late at night to prevent local residents being disturbed.

The Sub-Committee felt this variation of the premises licence will address the concerns about alcohol being brought on to the premises by customers. The Sub-Committee noted that 20:00 is the busiest time at the premises which drops to about 15 customers by 01:00.

The Sub-Committee were disappointed that the Premises Licence Holder may not have complied with licence conditions by failing to intercept alcohol being brought onto the premises by customers.

The Sub-Committee felt the Premises Licence Holder needed to be familiar with the conditions attached to the premises licence and ensure that they are strictly complied with to prevent offences being committed and the licensing objectives being undermined.

Having taken all of the above factors into consideration the Sub-Committee  was satisfied that by granting this variation of the premises licence, the licensing objectives would not be undermined.
