The decision
 
The Licensing Sub-Committee, in considering this decision
from the information presented to them within the report and at the
hearing and having regard to the promotion of the licensing
objectives:

the application for a premises licence has been approved in
accordance with the Council’s Statement of Licensing and the
proposed conditions set out in paragraph 8.1 of the report, with
the following amendments:

“Display a phone number and email address for local
residents to contact the duty manager/ member of staff with any
issues or concerns as they arise. A phone number for the premises
shall be made available if required upon request to the police, any
other responsible authority or any local resident to express any
concerns caused by the operation of the premises. Any complaints
and the outcome will be recorded in the incident
book”.
 
And the following conditions to be added to the
licence:

The Licensing
Authority to approve the capacity of the premises once the seating
and the site plan has been submitted to the Licensing Authority.
The maximum capacity to be determined shall be 30 persons at the
premises.

The Premises Licence
Holder shall organise and publicise a meeting for local residents
to discuss the operation of the premises and address any issues at
least every 6 months. The frequency of meetings may be varied by
agreement between the Premises Licence Holder and local
residents.
 
Reasons for the decision
 
The application for a premises licence has been approved,
as members of the Licensing Sub-committee were satisfied that the
licensing objectives would not be undermined.
 
The Sub-committee took into consideration that the
Responsible Authorities (the Licensing Authority, and the
Environmental Enforcement Team) made representations on the grounds
of prevention of public nuisance.
 
The Sub-committee took into account the representations
made by 6 Other Persons (local residents) objected to the
application. The Sub-committee heard that local residents had
concerns about noise late at night and early in the morning. The
Sub-committee heard that the local residents representing the
interests of their community would be affected by the operation of
the premises late at night.
 
In addition the Sub-committee heard that local residents
were concerned
about the number of events that would take place each week
and over the year which would affect them. The Sub-committee heard
that the local residents had concerns about the premises and the
hours of operation.
 
The Sub-committee noted that the Applicant is a resident of
the High Street and has the same concerns as the local residents
about noise in the area.
 
The Sub-committee took into consideration that the
Metropolitan Police Service ("the Police") agreed conditions with
the Applicant and withdrew their representation.
 
The Sub-committee heard representations from the Applicant
that alcohol would be served to seated customers and no live music
would be played. The Sub-committee noted that the Applicant is a
resident of the area living above the premises for the last two
years. The Applicant contended that they had about 14 temporary
events without incident holding private parties and no concerns
arising. The Sub-committee heard that the premises will have two
hour booking slots and a regular turnaround of
customers.
 
The Sub-committee took into consideration the above
conditions and the reduced hours that they felt that the premises
would operate responsibly in the future. The Sub-committee took
into account that the Applicant has experience of operating
temporary events and managing and dispersing  crowds. The Sub-committee noted that the Licensing
Authority received a Dispersal Policy from the Applicant which was
considered acceptable.
 
Having taken all of the above factors into consideration
the Sub-committee was satisfied that by granting this premises
licence, the licensing objectives would not be
undermined.
 
 
Public Informatives
 
The Premises Licence holder is encouraged to work with the
local
 
residents to deal with any issues arising relating to noise
nuisance.
 
The Premises Licence holder is advised as part of the
rigorous monitoring and checking that all staff are to be well
trained, and to undertake the required training including Wave
training, training for vulnerable persons and other training
offered by the Council’s Hackney Nights portal.
 
The Premises Licence holder is reminded of the need to
operate the
premises according to any current licensing conditions on
the premises
licence and planning permission relating to its use class,
conditions and hours.
 
It also should be noted for the public record that the
local planning
authority should draw no inference or be bound by this
decision with regard to any future planning application which may
be made.
