Decision

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

The hours of licensable activity were approved as set out in the report.

Amend Condition 23 to read as follows:

"No more than 16 customers shall be allowed to use the outside space at any one time".

And the following condition to be added to the premises licence:

·  Alcohol shall not be sold, supplied, or consumed on the premises otherwise than to persons who are taking substantial table meals and that the consumption of alcohol by such persons.

Reasons for the decision

The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. 

The Sub-Committee took into account that the Applicant agreed conditions with the Police and they withdrew their representation. The Sub-Committee took into consideration that there were 7 objections from local residents. The Sub-Committee noted that there were no representations from the other Responsible Authorities.

The Sub-Committee heard from the Applicant that it is a small premises which will open four days a week and two evenings with two staff. There will be a low footfall The Sub-Committee took into account that the indoor capacity is 14 customers and the outdoor capacity is 16 customers.

The Sub-Committee heard that the Applicant wrote to the local residents and invited them to a meeting to give them an opportunity to understand what the premises would be offering, however, there was no response. The premises had a temporary event last week with outdoor diners, and there were no complaints. The Sub-Committee noted the Applicant has a lease for the premises.

The Sub-Committee took into consideration the applicant has a zero tolerance policy for anti-social behaviour, and they will check the outside area regularly to ensure that there is no litter.

The Sub-Committee took into consideration representations from the Applicant that the premises will cause a limited disturbance to local residents. The Sub-Committee heard that the Applicant was happy to meet with local residents, and have a staggered booking system. The Applicant has also put in double glazed windows. The Applicant will ask customers to leave the premises quietly.

The Sub-Committee took into consideration representations from local residents who have concerns about the impact of the noise from the courtyard. The toilet at the premises is in the next unit. The external areas will be used until 10:30 pm.

The Sub-Committee after hearing the representations was satisfied that the Applicant will be a responsible operator and that the premises will enhance the area.

Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined.
