Decision

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

The hours of licensable activity were approved as set out in the report. 

Reasons for the decision

The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. 

The Sub-Committee took into consideration that the Applicant agreed conditions with the Responsible Authorities: Environmental Protection Services, and Environmental Enforcement who withdrew their objections, and 

there were no other representations from the other Responsible Authorities. It was noted that the premises had operated a number of temporary events at the premises.

The Sub-Committee took into consideration one representation from the previous operator and local resident on the grounds of public safety, prevention of public nuisance and concerns about the negative impact on the area.

The Sub-Committee took into consideration representations made by the new leaseholder (“the Applicant”) of the premises applying for a new premises license

The Sub-Committee heard that the Applicant had dealt with all the public safety concerns raised and they had been working closely with Hackney Council’s Property Services to ensure that the premises were up to standard and able to operate. The Sub-Committee heard about concerns about asbestos at the premises. The Applicant confirmed that a report had been carried out and found that an area, which does not form part of the premises, would be affected. It was noted from the report that there is a low grade category which has been dealt with, and the Applicant had taken the appropriate action.

The Sub-Committee took into account that the Applicant mitigated any impact on the area by the additional conditions that they have proposed on the premises licence. The Sub-Committee took into account that the off-sales of alcohol would be sold in sealed containers taken away by customers. It was noted that the premises have a dispersal policy.

The Sub-Committee after considering all the representations decided to grant this premises licence as they were satisfied it was similar to the current premises licence, and the Applicant added additional conditions. The Sub-Committee noted that the operating hours are aligned to the Council Licensing Policy except Sundays.

The Sub-Committee took into consideration the objection raised. However, they were not persuaded that a new premises licence should not be granted.

Having taken all of the above factors into consideration, and taking each application on its own merits, the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined.
