Decision

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

The hours of licensable activity were approved as set out in the report. 

And the following condition to be added to the premises licence:

·  No vertical drinking permitted on the premises.

Reasons for the decision

The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. 

The Sub-Committee took into consideration that the Applicant agreed conditions with the Environmental Enforcement Team who withdrew their objections, and there were no other representations from the other Responsible Authorities.

The Sub-Committee took into consideration one written representation from Other Persons (a local resident) on the grounds of public safety and prevention of public nuisance.

The Sub-Committee noted that the Applicant was unable to attend and representations were made on their behalf by their Agent. The Sub-Committee took into consideration that this was an application for alcohol to be consumed and served on the premises, the Applicant had agreed to all the proposed conditions and that the hours are aligned with LP3 (Core Hours) contained within the Licensing Policy.

The Sub-Committee heard that the premises will be operating as a café serving breakfast, lunch and dinner. The Applicant has applied to close the premises at 2230 to have some flexibility, however, they intend to close earlier.

The Sub-Committee took into consideration the written representation and the

objection received. The Sub-Committee felt that there was no evidence that the Applicant would not be a responsible operator. It was noted that the Applicant is a Personal Licence holder since 2016. The Sub-Committee noted that the Applicant has previously run a café for four years.

The Sub-Committee was not satisfied from the evidence that the Applicant

would undermine the licensing objectives.

Having taken all of the above factors into consideration, and taking each application on its own merits, the Sub-Committee was satisfied that by granting

the premises licence the licensing objectives would not be undermined.
