Decision

The Licensing Sub-Committee in considering this decision from the information presented to it within the report and at the hearing today has determined that having regard to the promotion of all the licensing objectives:

·  The prevention of crime and disorder;

·  Public safety;

·  Prevention of public nuisance;

·  The protection of children from harm;

the application to vary a premises licence has been refused in accordance with Licensing Policies LP1, LP2, LP3, and LP4 within the Council’s Statement of Licensing Policy.

Reasons for the decision

The Licensing Sub-Committee, after hearing the representations, believed that granting the application would result in the licensing objectives being undermined.

The Sub-Committee took into consideration representations from the Police.

On 15th of December 2023 the Police alleged that the licensee was in breach of a number of conditions attached to the licence, and alcohol appears to have been sold after the authorised hours. The Police felt that the Applicant appears to lack the understanding of the required conditions that need to be complied with.

The Sub-Committee heard that the Police were informed again of further potential breaches on the 16th of December 2023. It appears that although the premises have not been open for very long that the owner of the premises is unaware of the licensing requirements and the conditions on his licence which is a concern.

The Sub-Committee heard representations from the Applicant.

The Sub-Committee felt that the Applicant was not able to demonstrate why the hours for off-sales should be extended to 03:00 on weekdays.

The Sub-Committee took the alleged breaches of the premises licence very seriously and were not satisfied that an extension to the hours should be granted.

The Sub-Committee took into consideration when refusing this application that each case is considered on its merits. The Sub-Committee believed that the licensing objectives could not be promoted by granting this variation application, and as such it decided to refuse the application in its entirety.
