Decision

The Licensing Sub-Committee, in considering this decision from the information presented to them within the report and at the hearing and having regard to the promotion of the licensing objectives:

·  The prevention of crime and disorder

·  Public safety

·  Prevention of public nuisance

·  The protection of children from harm

The application for a premises licence has been approved in accordance with the Council’s Statement of Licensing and the proposed conditions set out in paragraph 8.1 of the report.

The hours of licensable activity were approved for all the licensable activities as on the report with the following amendments:

Supply of Alcohol (Off-Sales)

Monday    10:00 - 23:00

Tuesday    10:00 - 23:00

Wednesday 10:00 - 23:00

Thursday    10:00 - 23:00

Friday    10:00 - 23:00

Saturday    10:00 - 23:00

Sunday    12:00 - 23:00

And add the following condition to the licence:

·  The Premises Licence Holder shall provide a Crowd Management Plan to the Licensing Authority that shall be included in the premises Dispersal Policy and be available for inspection upon request from an authorised Council officer.

Reasons for the decision

The application for a premises licence has been approved as members of the Licensing Sub-Committee were satisfied that the licensing objectives would not be undermined. 

The Sub-Committee took into account that the Licensing Authority made a representation on the grounds of the prevention of Crime and Disorder and the prevention of Public Nuisance. The Sub-Committee took into consideration that there were no representations from local residents, and no representations from the other Responsible Authorities. The Sub-Committee noted that the Applicant had agreed conditions with the Police who withdrew their representation.

The Sub-Committee took into consideration that the Applicant’s solicitor confirmed the Applicant had reached an agreed compromise with the Police and the Environmental Protection Team, and was in discussions with the Licensing Authority to agree the conditions in relation to ‘Off-sales’. There were no resident objections except from the Licensing Authority which had been addressed by way of additional conditions and reduced hours and ‘Off-sales’ hours had been agreed.

The Sub-Committee took into account the Licensing Authority’s representations about the increased potential for Public Nuisance and Crime and Disorder and the cumulative impact of increased hours. The Dispersal Policy, Crowd Management Plan and other mitigation from the Applicant were welcomed however, their objections remained in line with the licensing objectives that granting extended hours

The Sub-Committee sought clarification on the Dispersal and Crowd Management Policy. The Applicant’s solicitor clarified that ‘Off-sales’ would be limited to core hours (11.00pm) in line with the Licensing Policy objectives. The Sub-Committee noted that the Police attended to assess the twenty person smoking area and noted it was well managed.

The Sub-Committee took into consideration that the Applicant agreed to a Dispersal Policy and Crowd Management Policy.

The Sub-Committee after hearing the representations took into account that the Applicant was seeking one hour extra on Friday and Saturday. The Sub-Committee noted that the premises held a number of temporary events. The Sub-Committee also took into consideration the Policy hours for off sales and the need for a Crowd Management Policy. The Sub-Committee felt a Crowd Management Policy will help with dispersal.

The Sub-Committee felt the hours of off-sales of alcohol needed to be reduced as a compromise to prevent the licensing objectives being undermined.

Having taken all of the above factors into consideration the Sub-Committee was satisfied that by granting the premises licence the licensing objectives would not be undermined.
