RESOLVED:
 
The decision
 
The Licensing Sub-Committee in considering
this decision from the information presented to it within the
report and at the hearing today has determined that having regard
to the promotion of all the licensing objectives:
 
• The prevention of crime and
disorder;
• Public safety;
• Prevention of public nuisance; and
• The protection of children from
harm,
 
the application for a premises licence has
been approved in accordance with the Council’s Statement of
Licensing Policy and the proposed conditions set out in paragraph
8.1 of the report, with the following amendments:

The hours for the supply of alcohol are:

premises:

Conditions 25, 34 and 35 shall be deleted from
the licence because there is no external activity .
 
· 
Condition 30 shall be deleted from the licence because it is a
duplication of condition 21.
 
· 
Late Night Refreshment shall be removed from the application.
 
· 
Condition 19 shall be amended to read as follows: 
 
“The licence holder shall
maintain a dedicated contact telephone number and  email address that must be available at all
times to all local residents, the
Environmental Health Officers, the
Licensing Authority, the police, and any responsible authority or
any person wishing to make a complaint. These contact details shall
be included on the website of the premises, and on display at the
premises  in a prominent external
location at the premises that is easily accessible to the public,
which can be used to report concerns or complaints about the
premises to a duty manager, a responsible person or a member of the
management team at the premises as and when they occur”.

Condition 33 to be amended and read as follows:
 
"After 22:00 customers shall exit the
premises from the rear exit to prevent noise nuisance, and there
shall be no customer access or exit on Mentmore Terrace after this time".
 
And the following additional conditions:
 
· 
There shall be no off sales of alcohol permitted at the
premises.
 
· 
The maximum number of patrons allowed at the premises shall not
exceed 50.
 
· 
No refuse and/or bottles are to be placed in external receptacles
or in areas outside the premises between 22:00 and 08:00.
 
· 
No use of the front access to the premises after 20:30pm except in
cases of emergencies. 
 
· 
Staff will ensure patrons leave the premises quietly from the rear
exit to their taxi pick up point or to other transport links.
 
· 
The Licence holder to hold and publicise quarterly liaison meetings
with local residents to address any concerns or complaints about
the premises from local residents to prevent public nuisance.
 
Reasons for the
decision 
 
The amended application has been approved,
with the above amendments, because the Licensing sub-committee was
satisfied that the licensing objectives would not be undermined by
granting the licence, and taking the factors below into
consideration.
 
The sub-committee took into consideration that
the Metropolitan Police Service and Environmental Enforcement had
withdrawn their representations, and agreed
conditions with the applicant in advance of
the hearing. The sub-committee also took into account that the
Licensing Authority withdrew their objection as the applicant
aligned their application with their Planning Permission It was
noted there were no objections received from the other Responsible
Authorities.
 
The sub-committee also took into consideration
the 18 objections raised by the Other Persons (local residents),
and their concerns about the impact the premises will have on local
residents due to noise and anti-social behaviour issues because the
premises are situated in a residential area. The sub-committee
noted that one local resident withdrew their objection, following
agreement of conditions 34 and 35 set out in the report, that there
will be no outside seating on Mentmore
Terrace or in the back courtyard. 
 
After hearing from the applicant, the
applicant’s representative, the Licensing Authority,
and  considering the representations of
the Other Persons (local residents) the sub-committee was satisfied
that the additional conditions, and the reduced hours would
mitigate any negative impact that granting the licence would have
on the residential area. It was also noted that there would be no
external seating or activity.
 
Following the applicant’s amended
application the sub-committee felt that the applicant had addressed
the concerns of the local residents. Also the applicant has
demonstrated that they have tried, and they are willing to engage
with the local residents to overcome their concerns such as
agreeing to remove off-sales of alcohol, and providing the use of
the back exit that would reduce the noise and prevent public
nuisance in the area.
 
Public
Informative
 
1. 
The Licence holder is encouraged to engage in meaningful dialogue
with the local residents to resolve any issues relating to the
premises, and for the Licence holder to play their part in reducing
any impacts of noise emanating from the premises, particularly
during the evening and late at night.
 
2. 
Should local residents encounter public nuisance and issues
relating to the premises that cannot be resolved with the licence
holder they should inform the Licensing Authority who can
investigate matters further
