Hampshire County Council is the Commons
Registration Authority for the purpose of exercising functions
under the Commons Act 2006. An application (ref. VG278) has been
made under Section 15(8) Commons Act 2006 for the voluntary
registration of land at Broadhurst Grove, in the parish of Old
Basing and Lychpit (‘the application land’) as a town
or village green. The applicant is the freeholder of
the land, and the Registration Authority is therefore required to
grant the application provided other conditions are met. Those
conditions appear to be met in this instance, and so it follows
that the application must be accepted.
The voluntary application follows the earlier submission of an
application (VG273) from the same applicant to register the
application land under Section 15(2) of the 2006 Act, on the basis
that the land had been used for lawful sports and pastimes, as of
right, for a period of at least twenty years. It has been agreed
with the applicant that, in exchange for the application for
voluntary registration, that this application should be withdrawn.
