Decision

RESOLVED that:

A     The council implements the recommendation of the council’s asset management adviser, detailed in Exempt Appendix 1, to Stuart James Hair.

B     Authority is given for the council to enter into a new lease covering Unit 62, Harvey Centre (the “Property”) on the headline terms set out in Exempt Appendix 1 to this report.

C     Delegation is given to the Director of Regeneration in consultation with the Executive Director, Communities and Regeneration to:

i)      Agree minor variations?to the?headline?terms set out in Appendix?1; 

ii)     Settle detailed terms including ensuring there is an appropriate budget; and 

iii)    Procure?the legal completion of the Agreement. 

Reasons for the decision

The professional asset management advice to the council is detailed in their report in Exempt Appendix 1.  This confirms the proposal is consistent with the council’s strategy set out in Building Harlow’s Future 2026/27, is on acceptable commercial terms and is therefore compliant with the council’s legal obligations under Section 123 of the Local Government Act 1972.
