Decision

We have carefully considered
the application by Samantha Higgins for a licence at Unit 2, 8-9
Harold Place Hastings, for a ‘Nightclub’ type premises.
We have considered the representations made by the Relevant
Authorities and residents both written and at the meeting. We have
not considered the additional information regards allegations of
illegality from HBC Environmental Health Emmett Turner as they were
out of time and not agreed by all parties.
Our decision takes into
consideration the Council’s Statement of Licensing Policy,
the Public Sector Equality Duty, the Home Office Guidance issued
under section 182 of the Licensing Act 2003 (s182 Guidance), the
duties under the Crime and Disorder Act 1998, and the rights set
out in the Human Rights Act 1998. Our decision is to reject the
application.
