Decision

 
We have carefully considered
the new licence application for Players Sports Bar, Former
Debenhams Building 1-3 Robertson Street submitted by Players Sports
Bar Limited, the report of Stewart Bryant (HBC Licensing) and
representations HBC Planning (a Relevant Authority) and 5 members
of the public and the Respondent’s evidence given at the
meeting. Our decision takes into consideration the Council’s
Statement of Licensing Policy, the Public Sector Equality Duty, the
Home Office Guidance issued under section 182 of the Licensing Act
2003, the duties under the Crime and Disorder Act 1998, and the
rights set out in the Human Rights Act 1998. We did not consider
the late representations in relation to the Applicants personal
debt matters.
 
Our decision is to grant the
licence subject to the following conditions:-
-         
Closing Hours on Tues-Thurs be changed to
22:30
-         
As per the Operating Schedule (those offered by you
in the application)
-         
Those agreed with Environmental Health and Sussex
Police, in addition:-
o  
The note from EH (Noise) be a condition that there
be no use of the bowling alley to be undertaken until an engineers
report is submitted detailing the mitigation measures to be
employed in order to avoid noise nuisance transference.
o  
Save that there be a condition that a Dispersal
Policy be put in place subject to agreement with the Licensing
Authority and Sussex Police prior to commencement of trading, to
include but not be limited to the Police recommendation to
communicate with local taxi firms.

And the following additional conditions:-
o  
Planning permission be obtained prior to the
commencement of trading.
o  
There be no vaping inside the licensed premises at
any time.
o  
A fire risk assessment be submitted to and approved
by East Sussex Fire and Rescue Authority prior to commencement of
trading.
o  
Bowling Alley be maintained at all times and reports
be made available to relevant Responsible Authorities upon
request.
o  
All customers under 18 years must be accompanied by
an adult of at least 21 years of age.
o  
The designated smoking/vaping area outside be used
by no more than 7 persons as any one time during opening
hours.
o  
Implementation of the Mitigation/Control Measures
from the CIZ Risk Assessment.
