Decision
The decision arises out of the tenants’
request for landlord’s consent to carry out alterations
comprising erection of a new general purpose agricultural storage
building which is permitted under the terms of that lease subject
to the consent of the landlord who must not unreasonably withhold
or delay the grant of consent.
The tenant has complied with the terms of their lease and there is
no reasonable ground on which consent should be withheld
The licence will require the tenant to seek and obtain all
necessary planning, building and any other necessary
approvals
Not granting consent may place the council in breach of its
obligations under the lease
Permitting the construction of the new building will enable the
tenant to improve the service offered to local businesses who use
the market
