Purpose

• A mains gas pipeline runs beneath the
land required for the Brookfield School redevelopment project and
must be diverted before the development can progress.
• The diversion will be routed through land owned by the
council part of which is leased to Arena Racing and forms part of
the racecourse.
• Cadent the mains gas supplier requires the council and Arena
Racing to enter into a permanent easement granting them the right
to install and thereafter use and maintain the pipeline before the
physical works to divert the pipe are carried out.
• Arena Racing have agreed to be party to the easement on
condition that the works to divert the pipe are completed as soon
as possible to allow the ground to settle before the start of the
forthcoming racing season and that their legal fees in the matter
are paid.
• The easement will be on standard Cadent terms and the
documents will be reviewed and approved by the council’s
legal team prior to completion. The council’s fees in dealing
with the matter will be part of the overall redevelopment
project
