To authorise proceedings under section 288 of
the Town and 
Country Planning Act 1990 in connection with a decision of
the Planning Inspectorate (on behalf of the Secretary of State)
relating to an appeal against a refusal of the Council’s
Planning Committee to grant outline planning permission for a site
at Horsham Golf Club, Denne Park, Horsham, RH13 0AX (Reference:
DC/23/1178).
 

Reasons for the decision

It is considered that the Planning Inspector
that heard the appeal made significant legal errors, including the
misapplication of national planning policy regarding sustainable
development and the Southwater Neighbourhood Plan.
 

Alternative options considered

Not to institute the subject
legal proceedings. This was rejected as the Planning Committee had
refused the application for outline planning permission. It is
considered appropriate to challenge the appeal decision
in order to give effect to the decision
of the Planning Committee and established policy.
