RESOLVED
 
i)             
That the following neighbourhood plans be formally made as part of
the statutory development plan for Horsham District:

 
a)
Cowfold Neighbourhood Plan (2019 – 2031)
b)
Itchingfield Neighbourhood Plan (2015 – 2031)
c)
Lower Beeding Neighbourhood Plan (2014 – 2031)
d)
Pulborough Neighbourhood Plan (2015 – 2031)

 
ii)            
That authority be delegated to the Director of Place, in
consultation with the Cabinet Member for Planning and
Infrastructure and with the consent of the relevant parish council,
to modify any of the above-mentioned neighbourhood plans
(i) for the purpose of correcting
errors or (ii) if the modification does not materially affect the
policies in the plan.
 
 
REASONS
 
i)             
To meet the requirements of the Planning and Compulsory Purchase
Act 2004 and the Neighbourhood Planning (General) Regulations
2012.

 
ii)            
To enable corrections and non-material modifications to be made to
the plans in a timely manner, to ensure the accuracy and
effectiveness of the plans.
 

 
 
ALTERNATIVE OPTIONS CONSIDERED BUT REJECTED AS
IDENTIFIED IN THE REPORT
 
The Council could decide not to make one of
the neighbourhood plans if it considered that doing so would
breach, or would otherwise be incompatible with, an assimilated
obligation (previously known as retained EU law) or any of the
Convention rights within the meaning of the Human Rights Act 1998.
Having taken into account the views of the examiners and having
regard to the wider legal implications set out in section 8 of this
report, it is not considered that this is the case. The Council was
therefore required to make the plans.
