Purpose

"To seek authority for the
Royal Borough of Kensington and Chelsea (RBKC) to enter into a
Section 75 (s75) partnership agreement under the NHS Act 2006 for
the management of the Better Care Fund (BCF). 
 
This agreement will be with the
North West London Integrated Care Board
(NWL ICB) and will cover the 2025/26 and 2026/27 financial years.

Decision

Lead Member for Adult Social Care and Public Health
1.   
Approved the Council entering into a section 75
partnership agreement with the North West London Integrated Care
Board for the period from 1 February 2026 until 31 March 2026 to a
value of £30.945m
2.   
Approved a delegation to the Executive Director for
Adult Social Care and Health to negotiate and finalise the terms of
the Section 75 Agreement with the North West London Integrated Care
Board.
3.   
Approved a delegation to the Executive Director for
Adult Social Care and Health to agree any variations to the section
75 agreement in consultation with the Lead Member for Adult Social
Care and Public Health.
4.   
Acknowledged the retrospective service commencement
of the section 75 partnership agreement from 1 April 2025 to 31
March 2026.
5.   
Approved delegated
authority to the Executive Director for Adult Social Care and
Health in consultation with the Lead Member to approve the Council
entering into the section 75 agreement, with the North West London
Integrated Care Board (or successor body) for the period from 1
April 2026 until 31 March 2027.
