Purpose

The purpose of this report is to seek approval and delegated authority from Cabinet for bringing forward the latest proposed Capital Receipts Schedule, delivering a targeted level of capital receipts in alignment with the Council’s approved budget and Capital Strategy. The report will also request that Cabinet consider objections to the loss of Public open space at Scarr End Lane, Earlsheaton.

Decision

RESOLVED

1)    That approval be given to the disposal of the land and property within the Capital Receipts Schedule October 2026 (Appendix A refers) to support the Council’s capital receipts income targets subject to consultation with the Portfolio Holder for Regeneration, Highways and Transport and delegates authority to the Executive Director for Place to negotiate and agree terms to complete the sale of any land and property identified within the schedule (Appendix A refers) in line with the legal requirements outlined in paragraph 3.3.1 and on such terms as Officers deem most appropriate.

2)    That approval be given the disposal of the land at Scarr End Lane, Earlsheaton shown edged red on the plan at Appendix C having considered and dismissed the objections to the disposal of public open space. 

3)    That authority be delegated to the Executive Director for Place to negotiate and agree terms to complete the sale of the land at Scarr End Lane, Earlsheaton shown edged red in the plan at Appendix C. 

4)    That authority be delegated to the Service Director (Legal, Governance and Commissioning) to enter into all agreements necessary to affect any of the disposals approved by this report.
