Purpose

To consider an application to
make a Definitive Map Modification by creating a
bridleway.  It is concluded that the
application does not meet the statutory requirements.  The report recommends that no Modification Order
be made.

Decision

The Assistant Executive Director for
Development and Infrastructure approves:
(a)      A refusal to make an Order
under Section 53(2)(b) of the Wildlife and Countryside Act 1981 to
modify the Definitive Map and Statement by adding a bridleway
between Points A and B, as shown on the plan at Appendix A
(b)      Informing the applicant
and landowners of the decision and to provide details of their
rights to appeal to the Secretary of State.
(c)      Publishing details of the
decision on the Council’s website in accordance with the
requirements of the Wildlife and Countryside Act 1981.

Alternative options considered

The alternative option considered was to
support the application and make an Order to amend the Definitive
Map Statement as requested however this option has been rejected
because the proposed route does not satisfy the statutory
requirements.
