Purpose

The purpose of the report is to seek approval to modify the
contract with Ralph Livesey Ltd for Supply of Chilled Goods in
accordance with Public Contract Regulations 2015 as
follows:

Regulation 72(1)(a)
– by extending the contract by 12 months from 31st January
2026 until 31st  January
2027.
 
The reasons for the decision are allowed by Public Contract
Regulations 2015, Regulation 72(1)(a). The modification is provided
for within the existing contract at clause 3.1 of the Framework
1114 – YPO Food Deal Call Off Terms and Conditions for
Chilled Foods in precise and clear detail with regards to scope,
nature and conditions under which the modification may be
used.
 

Decision

The Assistant Executive Director (Neighbourhoods and
Commercial Services) approved;
(i)            
That, in accordance
with Public Contract Regulations 2015, Regulation 72(1)(a), the
contract with Ralph Livesey Ltd for Supply of Chilled Goodsbe
modified by extending the term as provided for within the existing
contract at clause 3.1 of the Framework 1114 – YPO Food Deal
Call Off Terms and Conditions for Chilled Foods from 31st January
2026 by 12 months (1 year) until 31st January 2027; and
 
(ii)           
That the Procurement
Team be authorised to issue the relevant contract modification
documentation.
 

Alternative options considered

Do Nothing: This option was considered and
rejected as the Supply of Chilled Goods contract held by Ralph
Livesey Ltd would expire and we would need to reprocure a new
contract which would compromise the ability of the service to meet
its obligation to feed children in Schools across the borough.
 
Seek Competition (Quotation / Tender): Ceasing
the contract and reprocuring would not be prudent at the current
time due to the volatility in pricing of the products contained
within the contract, it is most likely that if we opted to try to
let a new contract for Supply of Chilled Goods the commercial terms
are highly likely to be less favorable due to the continued
inflationary pressures in the food supply industry. As well as
being unlikely to secure better commercial terms for comparative
products there would also be increased disruption whilst an
alternative supplier was sought.
