West Dulwich Street Improvements, Brockwell Park to Gipsy Hill Healthy Route Phase 3 and Controlled Parking Zone (CPZ) – outcome of informal consultation

Purpose

This report outlines the outcome of the non-statutory public
engagement undertaken between April – May 2023 and the
evidence and rationale to:
• introduce experimental Low Traffic Neighbourhood (LTN)
street improvements;
• undertake statutory consultation on extending the Brockwell
Park to Gipsy Hill Healthy Route on Rosendale Road (between the
A205 South Circular and Park Hall Road); and
• undertake statutory consultation on the introduction of a
controlled parking zone in the West Dulwich area described in this
report.

Decision

 
1.             
To note the results of the consultation undertaken
for the purposes of this report (Appendices A and B)
 
2.             
To issue scheme approval for the West Dulwich Street
Improvement scheme including traffic restrictions and waiting
restrictions in the area bounded by the South Circular Road (A205),
Norwood Road (A215) Croxted Road (A219) and Robson Road.

3.             
To authorise the undertaking of statutory
consultation under Regulation 6 of the Local Authorities Traffic
Orders (Procedure) (England & Wales) Regulations 1996 (the 1996
Regulations) on an experimental traffic management order for
traffic and parking restrictions in the West Dulwich Street
Improvements scheme shown in Appendix C.

 
4.             
That subject to the approval in recommendation 2 and
due regard being given to the outcome of the consultation referred
to at recommendation 3, to implement the proposed restrictions as a
trial under an experimental traffic management order made under the
provisions of Sections 9, 10, 124, Schedule 1 and Part IV of
Schedule 9 of the Road Traffic Regulation Act 1984 (RTRA 1984) and
that the notices of making for the Experimental Traffic Management
Orders contain the statements specified in Schedule 5 of the Local
Authorities’ Traffic Orders (Procedure) (England and Wales)
Regulations 1996.
 
5.             
That, after consultation with the Chief Officer of
Police, any modifications to any Experimental Order which renders
it less restrictive may be authorised by a Director or Assistant
Director in Resident and Enabling Services without the requirement
to re-advertise the Order under Section 10(2) of the said
Act.
 
6.             
To delegate authority to a Director or Assistant
Director in Resident and Enabling Services to authorise any
modifications to the Experimental Traffic Order in the event of
objections being received from the statutory consultation referred
to at recommendation 3. 

 
7.             
To undertake a public engagement exercise with local
stakeholders to determine the future of the scheme and to consider
both the public engagement feedback and any material objections or
representations resulting from the statutory consultation referred
to in recommendation 3 above by way of a separate decision report
by a Director or Assistant Director of Resident and Enabling
Services on whether to make permanent or abandon the
scheme.

 
8.             
To issue scheme approval and authorise the
undertaking of statutory consultation under Regulation 6 of the
Local Authorities Traffic Orders (Procedure) (England and Wales)
Regulations 1996 on permanent traffic orders (TMOs) for traffic and
parking restrictions in Phase 3 of the Brockwell Park to Gipsy Hill
Healthy Route (between the A205 and Park Hall Road) and to
authorise officers to issue statutory notices for new pedestrian
crossings under section 23 of the Road Traffic Regulation Act 1984,
and to authorise officers to issue statutory notices for proposed
road humps under Section 90C of the Highways Act 1980,
as detailed in this report.
 
9.             
To agree the controlled parking zone design in
Drawing No. DES-CPZ-N-2021-001 Rev B (Appendix C) that fully
integrates with scheme designs for the Brockwell Park to Gipsy Hill
Healthy Route scheme and the West Dulwich Street Improvements
scheme and includes the provision of Electric Vehicle (EV)
recharging bays and Cycle Hangars, to take account of public
engagement feedback as described in this report.
 
10.          
To issue scheme approval and authorise the
undertaking of a statutory consultation under Regulation 6 of the
Local Authorities Traffic Orders (Procedure) (England and Wales)
Regulations 1996 on the proposals set out in recommendation 9 to
introduce a new Controlled Parking Zone (CPZ) operating Monday to
Friday, 10am - 4pm as illustrated in the revised Drawing No.
DES-CPZ-N-2021-001 Rev B) in Appendix C to this
report.
 
11.          
That subject to the above approvals for the healthy
route and controlled parking zone in recommendations 8 and 10 and
having due regard to the outcome of the statutory consultations, to
agree to the implementation of the schemes and making of permanent
traffic management orders under sections 6, 45, 46, 49, 124 and
Schedule 1 and Part IV of Schedule 9 of the Road Traffic Regulation
Act 1984 subject to no material representations or objections being
received.
 
12.         
That any material objections or representations
resulting from the statutory consultation for the healthy route and
controlled parking zone referred to in recommendations 8 and 10
above will be considered by way of a separate decision report by a
Director or Assistant Director of Resident and Enabling Services
prior to any decision being taken on whether to proceed with, amend
or withdraw the approved schemes.
 
13.          
To notify the London Borough of Southwark of this
proposed controlled parking zone in accordance with the
requirements of Section 121B of the Road Traffic Regulation Act
1984.
 
14.          
To have regard to the Equality Impact Assessments
prepared for the purposes of this report in Appendices K, O and
P.
