Purpose

On 7 August 2024, the council made a
non-immediate Article 4 Direction withdrawing the Class L (b)
permitted development right allowing a change of use from
dwellinghouses to small HMOs in the wards of Streatham Common &
Vale and Streatham St Leonard’s. This report seeks to confirm
that decision, allowing the Article 4 Direction to come into effect
from 7 August 2025.

Decision

1.1 To agree that the
Council confirms the non-immediate Article 4 Direction to remove
the permitted development right under Class L(b) of Part 3 of
Schedule 2 of the GPDO 2015 for the change of use from residential
(Use Class C3) to small HMO (Use Class C4) in Streatham Common and
Vale, and Streatham St Leonard’s.Article 4
Direction would come into force 11
August 2025, and
the cost would be less than £500
which will be met from
existing revenue budgets for
2025/26. 
 

1.2 To delegate
authority to the Assistant Director of Policy and Placeshaping to carry out all necessary
steps under the statutory procedure for the confirmation of the non-immediate Article
4 Direction and to instruct officers to carry out all necessary
consequential arrangements to give effect to the terms of
recommendations (1) which shall include publishing the
confirmation of the Article 4
Direction and notifying
the Secretary of State.
