Purpose

This decision report is seeking approval to
deliver the Stockwell Gardens Healthy Neighbourhood trial under an
Experimental Traffic Order (ETO). This scheme forms part of the
Healthy Neighbourhood Plan 2024-2025.

Decision

1.         
To have due regard to the engagement activity
undertaken through two stages with local residents, stakeholders,
and statutory consultees during the development of the Stockwell
Gardens Healthy Neighbourhood proposals, as detailed in Section 5
of this report and summarised in Appendix A and Appendix B
– Concerns Raised and Officer Response Table.

 

2.         
To note the Equality Impact Assessment attached at
Appendix C.
 

3.         
To note scheme approval provided by the Phase 3
Transport Programme – Capital Drawdown report of 10/09/2024
for the Stockwell Gardens Healthy Neighbourhood trial in the area
bounded by Clapham Road (A3), Stockwell Road (A03) and Landor Road
as illustrated in Appendix D commencing by Autumn 2025.
 

4.         
That giving due regard to the outcome of the
engagement activity with local residents and stakeholders and the
statutory consultation under Regulation 6 of the Local Authorities
Traffic Orders (Procedure) (England and Wales) Regulations 1996
(the 1996 Regulations), pursuant to the delegated authority set out
in recommendations 5 and 6 below, to implement the scheme detailed
in this report, under an Experimental Traffic Management Order
(“Experimental TMO”)made under the provisions of
Sections 9 and 10 of the Road Traffic Regulation Act 1984 and
Regulation 22 of the Local Authorities’ Traffic Orders
(Procedure) (England and Wales) Regulations 1996.
 

5.         
To note the representations received as part of the
statutory consultation and to delegate authority to the Assistant
Director – Parking, Network Management and Fleet, to
authorise any modifications to the Experimental TMO that are
considered necessary as a result of any objections being received
or incapable of satisfactory resolution by modifications to the
Experimental TMO.
 

6.         
Following the outcome of the statutory consultation
to exercise discretion to not hold a public inquiry pursuant to
Regulation 9 of the Local Authorities Traffic Orders (Procedure)
(England and Wales) Regulations 1996.
 

7.         
That, after consultation with the Chief Officer of
Police, modifications to the Experimental Order which renders it
less restrictive may be authorised by the Assistant Director
– Parking, Network Management and Fleet, without the
requirement to re-advertise the Order under Section 10(2) of the
Road Traffic Regulation Act 1984.
 

8.         
To undertake a non-statutory consultation exercise
with local stakeholders prior to any decision being made upon
whether to make the provisions of the experimental order
permanent.

9.         
To note the public realm and kerbside improvements
at St Andrew’s Church of England (CofE) Primary School will
be funded by the EU Horizon Just Streets grant.

 

10.      
That any valid objections received within the six
month period under Schedule 5 of the Local Authorities’
Traffic Orders (Procedure) (England and Wales) Regulations 1996 be
considered by way of a separate written report to the Deputy Leader
of the Council (Sustainable Lambeth and Clean Air) before a
decision is reached on whether any of the provisions of the
experimental order will be made permanent and on whether a public
inquiry should be held in relation to the permanent
order.
 

11.      
To approve the projected
spend of £203,568 and £20,000 by the end of
2025.
