Purpose
This report seeks authorisation to proceed
with the process of drafting, consulting upon and ultimately making
of stopping up orders in support of development works that have
planning permission granted. Stopping up orders are used to
extinguish public highway rights on land used for public roads
where that land is required to facilitate private development.
Alternative road layouts are proposed as a part of the approved
developments.
Clapham Park Regeneration development requires the stopping up of
sections of the public highway on Headlam Road, to enable the
development for which planning permission was granted under
reference 17/03733/FUL.
Royal Street Site, South Bank, London, SE1 7LW development requires
the stopping up sections of the public highway on Carlisle Lane,
Royal Street and Upper Marsh, to enable the development for which
planning permission was granted under reference
22/01206/EIAFUL.
Decision
1.
That upon receipt of payment of £9,080 from
the applicant, to approve the spend by the Council to commence the
stopping up order processes. The Council will publish a notice of
intent to make an order (the “Order”) under section
247(2A) of the Town and Country Planning Act 1990 (the
“Act”) to remove (“stop up”) the part of
Headlam Road as illustrated on drawing ‘Headlam Road, stopping up order hatch
area plan’ 11609-PPC-ZZ-XX-DR-C-0360 Revision P2
(appendix A).

That upon receipt of payment of £9,080 from
the applicant, to approve the spend by the Council to commence the
stopping up order processes. The Council will publish a notice of
intent to make an order (the “Order”) under section
247(2A) of the Town and Country Planning Act 1990 (the
“Act”) to remove (“stop up”) the parts of
Carlisle Lane and Royal Street as illustrated on drawing
267582-00-T-SU-003 Rev E (appendix B) and 267582-00-T-SU-005 Rev C
(appendix C).

That upon receipt of payment of £9,080 from
the applicant, to approve the spend by the Council to commence the
stopping up order processes. The Council will publish a notice of
intent to make an order (the “Order”) under section
247(2A) of the Town and Country Planning Act 1990 (the
“Act”) to remove (“stop up”) the part of
Upper Marsh as illustrated on drawing 267582-00-T-SK-043-A –
Phase 2 Stopping Up (found in appendix D).

The 28-day consultation period is expected to start
in January 2026. If by the end of the 28-day consultation period,
no objections have been received, or any objections received are
withdrawn, then the Assistant Director of Infrastructure,
Environment, Public Realm and Climate Change Delivery will request
that the Order be made as an unopposed Order.
5.
If objections are received and are not withdrawn and
the Mayor of London decides that an inquiry is necessary, the
Council shall cause an inquiry to be held.
