Purpose
Approval has been granted in principle for the strategic exploration and redevelopment of the Council owned Leigham Court Road car park site, off Leigham Court Road, for residential use. This proposal is part of a wider, comprehensive development comprising three adjoining sites, including the car park area.
This report seeks approval to undertake a statutory consultation under the Road Traffic Regulation Act 1984 on the revocation of parking controls in the Leigham Court Road off-streetcar park and the subsequent necessary amendments to the supporting Traffic Management Order (“TMO”) to facilitate the development.
The final determination on whether to make the relevant TMO under sections 35 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 after considering feedback from the statutory consultation process.
This report replaces a previous report which was withdrawn prior to becoming an approved decision in response to representations received from members of the public. It includes a revised draft Equality Impact Assessment (“EIA”) to address localised amenity and accessibility requirements neutrally. The EIA will be updated and finalised following the consideration and completion of the consultation.
Decision
1 The recommendations are as follows:
- 1 To authorise officers to commence a statutory consultation under the Road Traffic Regulation Act 1984 and in accordance with the Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 on the revocation of the Leigham Court Road car park from the Lambeth (Off-Street Parking Places) (Amendment No. 1) Order 2023, as described in this report, with the statutory consultation period scheduled to take place during November/December 2026 (with any future closure date dependent on outcome of the statutory consultation as outlined in recommendation 2).
- 2 To delegate authority to the Assistant Director for Parking, Network Management and Fleet to formally determine whether or not it is necessary or appropriate to hold a public inquiry pursuant to Regulation 9 of the Local Authorities Traffic Orders (Procedure) (England and Wales) Regulations 1996, following a full review of the consultation responses.
2 The following points should be noted:
- 1 The final determination on whether to make the relevant TMO under sections 35 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 will be determined after considering the feedback from the statutory consultation process. If any objections are received, they will be considered by the Assistant Director of Parking, Network Management and Fleet by way of a separate, transparent written report before any final decision is reached.
- 2 A revised and final EIA shall be appended to the final report following the Council’s statutory consultation. A draft copy is enclosed to this report.
