Decision

To authorise officers to carry out
statutory consultation to amend parking restrictions as shown in
Appendix B in accordance with the Local Authorities Traffic Orders
(Procedure) (England and Wales) Regulations 1996 and to authorise
officers to issue statutory notices for proposed road humps under
Section 90C of the Highways Act 1980 for the proposed permanent
SuDS scheme outside Jessop Primary School as described in section
two of the report. 

 

To grant scheme approval for the
proposals described in section two of this report and illustrated
in the design drawings attached in Appendix B, at an estimated cost
of £224,166 to be implemented in Autumn 2024 and complete by
March 2025. Note that this includes £52,386 of design costs
which have already been incurred. 

 

That subject to the approval in
recommendation two and having due regard to the outcome of the
statutory consultation in recommendation one above, and where no
material representations are received, to implement the scheme
(January - March 2025)and make new permanent traffic management
orders under the provisions of sections 6, 45, 49, 124 and Schedule
1 and Part IV of Schedule 9 of the Road Traffic Regulation Act
1984. 

 

That where material objections are received during
the statutory consultation process referred to in recommendation
one, that any such objections received will be considered by way of
a separate written report to the Director for Highways,
Environment and FM before a decision is reached on whether or not to
proceed. 

 

To exercise discretion not to hold a
public inquiry pursuant to Regulation 9 of the Local Authorities
Traffic Orders (Procedure) (England and Wales) Regulations 1996 and
section 90C of the Highways Act 1980. 

 

Subject to approval of
recommendation three above, to transfer a total of £171,780
from the existing project budget for Highways 2022-2025 SuDS within
the Capital Investment Programme (CIP) approved by Cabinet in July
2020 to fund the remaining project costs.  

 

To have regard to the Equality
Impact Assessment prepared for the purposes of this report
(Appendix A)
