Decision

The Chief Officer (Highways and
Transportation) was requested to:

a. Note the detail of the highway works described in outline in
paragraph 4 of the Design and Cost Report and shown on plan
733648-LCC-HWT-NA-M2-CH-GA attached at Appendix 3 of the Design and
Cost Report;

b. Give authority to negotiate the terms of and enter into an
agreement with the developer under the provisions of Section 278 of
the Highways Act 1980; whereby the works associated with the
development are carried out by Leeds City Council, fully funded by
the developer.

c. Give authority to complete the detailed design, tender and
implement the works as set out in outline in paragraph of the
Design and Cost Report .

d. Give authority to incur expenditure of £1,718,125.00 works
costs and £274,900.00 staff costs to be fully funded by the
developer through the S278 Agreement.

e. Approve the adoption of new highway construction on land shaded
red on drawing ‘land to be dedicated as highway’ rev.
P01.01 so that it can be added to the Council’s maintenance
regime, subject to formal appropriation of LCC land (report
pending)

f. Authorise the City Solicitor to erect notices under s23 of the
Road Traffic Regulation Act 1984 on site as required for the
establishment of a new toucan crossing on Leeds Road and for
alteration of the existing toucan crossing on Leeds Road located to
the west of ELOR to accommodate new kerb lines. If no valid
objections are received, to thereinafter implement.

g. Approve with reference to the powers contained in Section 66(4)
of the Highways Act 1980, that the relevant lengths of footway
along the northern side of Leeds Road shown as new carriageway on
plan 733648-LCC-HWT-NA-M2-CH-GA are removed to construct new
carriageway.

h. Approve with reference to the powers contained in Section 66(4)
of the Highways Act 1980, that the relevant lengths of footway
along the eastern side of Smeaton approach up to the junction with
Leeds Road show as proposed cycle tracks on plan
733648-LCC-HWT-NA-M2-CH-GA are removed and that following the
removal of the footways, cycle tracks are constructed under the
powers contained under the provisions of section 65(1) of the
Highways Act 1980.

i. Approve with reference to powers contained in Section 65 (1) of
the Highways Act construction of shared used footways / cycleways
as shown hatched pink on plan 733648-LCC-HWT-NA-M2-CH-GA.

j. Approve with reference to powers contained in Section 65 (1) of
the Highways Act construction of cycle tracks on Leeds Road,
Smeaton Approach and the development access road as shown hatched
light blue on plan 733648-LCC-HWT-NA-M2-CH-GA.

k. Approve with reference to powers contained in Section 66 (1) of
the Highways Act construction of footways as shown on plan
733648-LCC-HWT-NA-M2-CH-GA,
i. along the north and south side of Leeds Road
ii. along the eastern side of Smeaton Approach from the junction
with Leeds Road towards the south for a length of circa 50m.
iii. along both sides of the new vehicular access.

l. Approve with reference to powers contained in Section 96 (1) of
the Highways Act the planting of trees and grass verges as shown in
light green on plan 733648-LCC-HWT-NA-M2-CH-GA.

m. Approve with reference to powers contained in Section 96 (2) of
the Highways Act the removal or alteration of existing grass verge
along the southern side of Leeds Road and along the northern side
of Leeds Road between ELOR toucan crossing and roundabout as shown
on plan 733648-LCC-HWT-NA-M2-CH-GA.

n. Authorise the City Solicitor to advertise a notice under the
provisions of Section 90C of the Highways Act 1980 in order to
inform the public of the new raised table on the new site access
road and if no valid objections are received, to continue with the
works as advertised.

o. Authorise the City Solicitor to advertise a Draft Traffic
Regulation Order to implement no waiting at any time (NWAAT) ) /
restrictions as shown on plan 733648-LCC-HWT-NA-M2-CH-GA; and if no
valid objections are received, to make, seal and implement the
Order as advertised; If objections are received when advertised
these will be reported back to board.

p. Authorise the City Solicitor to advertise a Draft Traffic
Regulation Order to extend the 30mph speed limit from the junction
between Leeds Rd/Smeaton Approach to immediately east of the
existing ELOR roundabout as shown on plan
733648-LCC-HWT-NA-M2-CH-GA; and if no valid objections are
received, to make, seal and implement the Order as advertised; If
objections are received when advertised these will be reported back
to board.
