Decision

The Chief Officer (Highways and
Transportation) has:

a) Noted the details provided in in the Design and Cost report and
as shown on the plans included at Appendix 3;

b) Given authority to negotiate the terms of and enter into an
agreement with the developer under the provisions of Section 278 of
the Highways Act 1980; whereby the highway works associated with
the development are carried out by the Council on behalf of the
developer;

c) Requested the City Solicitor to advertise a Draft Traffic
Regulation Order (TRO) and Speed Limit Order (SLO) for respectively
waiting restrictions and 20mph speed limit extension; and if no
valid objections are received, to make, seal and implement the new
TRO and SLO as advertised;

d) Requested the City Solicitor to advertise a notice under the
provisions of Section 90c of the Highways Act 1980 and if no valid
objections are received, to continue with the works as
advertised;

e) Given authority to advertise a notice under the provisions of
Section 23 of the Road Traffic Regulation Act 1984 in order to
inform the public of the new zebra crossing position on Sir George
Martin Drive, Adel;

f) Approved the adoption of new highway construction on the land
shaded blue on drawing number 144 P1 so that it can be added to the
Council’s maintenance regime; and

g) Given authority to incur capital expenditure of circa
£93,000 consisting of circa £77,550 civil works costs
and circa £15,450 staff fees. The costs will be fully funded
by the developer through the Section 278 Agreement.
