Purpose

To obtain delegated authority to grant a
30-year community asset transfer lease to Valley Community Theatre
at Valley Community Theatre, Childwall Valley Road, Netherley,
Liverpool, L27 3YA

Decision

For the reasons set out in this report, the
Director of Property has decided to:
1)   
Grant consent for a new 30-year lease of Valley Community Theatre
on the terms set out in Appendix 2.

Alternative options considered

3.1      The Council could choose
not to grant the lease and not dispose of the Property but the
Council would need to seek vacant possession and remove the
organisation from the Property which is likely to be unpopular with the local
community. There are also legal implications with this option
as the current lease is not contracted out of the Landlord and
Tenant Act 1954 meaning the tenant has a right to renew. Lastly,
the Council would retain all the liabilities for the Property and
would not generate any income.
 
3.2      The Council could choose
to dispose of the Property for non-CAT purposes such as a disposal
to obtain a capital receipt. However, the Council would need to
secure vacant possession and removing the organisation from the
Property is likely to be unpopular with the local
community.  Under the Landlord and
Tenant Act 1954 the Council can only secure vacant possession under
limited circumstances set out in the Act.  This would be challenging as the Council does not
have justification for refusing to grant a renewal lease to
VCT.
