Purpose

shop.
Decision
For the reasons set out in this report, the
Corporate Director has decided to:
1)
Make a compulsory purchase order (“the Order”) under
the provisions of s17 (1) (b) of the Housing Act 1985 to acquire
the land and buildings at 309 Lower Breck Road, Liverpool L6 0AF,
shown edged red on the attached plan (Appendix 1).
2)
Approve the attached Statement of Reasons for the making of the
Order Appendix 2).
Alternative options considered
Do nothing. The property will continue to
deteriorate. There is a risk that the property may become
structurally compromised over time without appropriate
intervention. The council may be forced to undertake further works
in which to safeguard the public interest. This will result in a cost implication to the
council.
Enforced sale as mortgagee in possession.
Given there are charges registered against the property, the
council could enforce its sale under the Law of Property Act 1925,
either by auction or tender. Whilst this would facilitate the
onward sale, there is a risk that: (1) the Property fails to
attract a purchaser given its dilapidated condition (2) that a
purchaser simply acquires the property for the purpose of land
banking with no immediate intention to bring the Property back into
beneficial use in the short-term.
