Decision
The Leader took Members to a vote on the
recommendations which were agreed unanimously
RESOLVED
Cabinet:
1.
Agreed in principle to negotiate purchase of the Site and, if
required, to do so through the making of a Compulsory Purchase
Order under Section 226(1)(b) of the Town and Country Planning Act
1990 (as amended) and, the Acquisition of Land Act 1981, subject to
the appropriate governance.
2.
Delegated authority to the Director People and Commercial Services
(in consultation with the Director of Resources and Organisational
Development, and the Monitoring Officer) the power to commence
negotiations and preparatory work with a view to proceeding with
the compulsory purchase of the Site should it be considered
appropriate. In so doing Officers should have regard to:
i.
progress of works on the Site returning the Site to beneficial use;
and
ii.
updated and detailed financial estimates of costs and potential
receipts arising from purchase and/or works and resale and, subject
to confirmation of such order by the Secretary of State for the
Department of Communities and Local Government;
