Purpose

To consider adopting a new Fly-tipping Action Plan, including Fly-tipping Fixed Penalty Notices, DVLA Vehicle and Vehicle Management powers.

Decision

  1. That the Fly-Tipping Action Plan 2026 to 2029, attached at Annex A to the report, be adopted.
  2. That the levels of monetary penalties in relation to Fixed Penalty Notices (FPNs) for Fly-Tipping - £400 (reduced to £275 if paid within 14 days) for smaller offences; £600 (reduced to £400 if paid within 14 days) for transit van-load sized offences; and £1,000 (reduced to £750 if paid within 14 days) for larger, multiple and commercial offences, be approved.
  3. That the Council adopts powers to remove untaxed vehicles from land in its area and to procure a contractor to act on its behalf.
  4. That the commencement of a procurement exercise of a fixed term contract for a trial to target affected locations to remove and store untaxed vehicles from land in the Local Authority area, be approved.
  5. That the Council adopts powers to seize vehicles used to illegally transport waste and dump rubbish under the Control of Waste (Dealing with Seized Property) (England and Wales) Regulations 2015.
