The Sub-Committee carefully considered all the evidence
before it, including all the evidence from the applicant’s
representative and the representation from Max Kebabs.
It noted that there could be a competitive challenge to the
established business but did not consider this as a reason not to
grant the consent.
It was of the opinion that, in order to give Max Kebabs a
clear hour to trade prior to Tasty Turkish Kebab opening, the hours
of trade be reduced by
30 minutes.
There would be an opportunity for the applicant to submit a
further application to extend their hours after trading for 21
days, and if any objections on how Tasty Turkish Kebab had impacted
on Max Kebabs, evidence to support this should be presented to the
Licensing Authority
The Sub-Committee resolved to grant the application, with
the hours of trading between 17:30 hours and 20:00
hours.
