Title of Decison Requested: 13314 -
Enforcement Notice Morsha King Street Ilfracombe
Reasons for the decision
1.1. The rear extension has been built to the
drawings on the refused planning permission ref 73058 and 75968.
This development was assessed against the policies of the Local
Plan and was refused for the following reason:
The proposed two storey rear extension, by reason of its size,
scale, siting and design, would be incoherent with the character
and appearance of the dwelling and its setting in the street scene,
contrary to policies DM04 and DM25 of the North Devon and Torridge
Local Plan.
1.2. With regards to the alteration/extension to the front
elevation, these also do not comply with the approved planning
permission ref 72714. All the works appear to fall outside of
permitted development (Schedule 2, Part 1, Class A of the GPDO).
However, whilst not totally respecting the character and design of
the existing dwelling, it is not of such a poor design as to
warrant a refusal, or proceed with further Enforcement
action.
1.3. The resultant appearance of the rear elevation of this
property does not accord with the traditional appearance of the
original elevation of the dwellinghouse and rest of the street
scene. Whilst this is not a listed building nor within a
Conservation Area, the buildings in the locality with canted bay
windows and overhanging front canopies have value in the street
scene. It is considered the front and rear extensions as developed
are incoherent with the form of the original dwelling and that of
dwellings within this locality. The development is also considered
to result in unacceptable harm the character and appearance of the
area contrary to policies ST04 and DM04 of the Local Plan.
Alternative options considered
3.1. There are no other actions the Council
can take to remedy this breach of planning control. The owner has
not willingly complied with requests to remedy the breaches.
Retrospective planning permission was refused and the appeal
dismissed.
