Title of Decison Requested: Legal action to
ensure compliance with an Enforcement Notice at Flat 1, 1 Hostle
Park, Ilfracombe, EX34 9HW case ref 9353

Reasons for the decision

1.1. On 25 August 2016 an Enforcement Notice
(‘the EN’) was issued for “Without planning
permission and within the last 4 years, unauthorised
1.2. Operational Development consisting of the installation of
uPVC
1.3. windows.” The Enforcement Notice took effect on 26
September 2016 and gave 6 months for compliance (or by 26 March
2017). The steps on the EN require:
“1. Replace the unauthorised uPVC windows with traditional
timber framed vertical sliding sash windows.
2. Make good any damage caused to the Building from complying with
Step 1 above.”

1.4. The Enforcement Notice was not appealed, and compliance was
due on 26 March 2017.

The Council consider that all other possible
remedies have been used but no resolution has been
reached.
