To Waive the request for waiver and award the
Crematorium Solar Panel Project contract to Cook Electrical Ltd for
the Crematorium Solar Project

Reasons for the decision

1.1. When the Crematorium Solar Panel Project
was procured, tender documents required Professional Indemnity (PI)
cover of £1,000,000 as part of its suitability assessment
criteria.
1.2. Cook Electrical Ltd were successful in winning the contract,
but post award were unable to secure £1,000,000 PI
cover.
1.3. They have managed to secure £300,000 PI cover and this
is considered by the project team to be adequate for a project of
this size and value.
1.4. When the procurement papers were prepared for this project, a
standard figure for PI was used, but with hindsight it has become
evident this figure was excessive, given the limited design and
advice with the contract and the potential financial risk to the
project of incorrect advice.
1.5. Despite the above, based on the submission by Cook Electrical
Ltd, the award to Cook Electrical is considered best value for the
Council. Their bid scored highest on price and compliance.

Alternative options considered

3.1. Re-running the tender process was
considered but thought unnecessary as the lower insurance figure is
thought to be too small to affect the likely outcome of the tender
process.
