Reasons for the decision

1.1. The property has been empty since 2016,
when the owner passed away
1.2. The condition of the gardens have deteriorated and they
continue to significantly adversely affect the amenity of the
neighbours and locality
1.3. An abandoned (untaxed and uninsured) motor vehicle has
remained on the driveway
1.4. A notice under section 215 of the Town & Country Planning
Act 1990 was issued 30 July 2025 requiring steps to be taken to
improve the appearance of the property
1.5. The compliance period of the s215 notice ended 10 October
2025
1.6. The steps required by the s215 notice have not been complied
with and the condition of the property has deteriorated and
continues to significantly adversely affect the amenity of the
neighbours and locality
1.7. The deceased owner’s executor has failed to engage or
apply for probate
1.8. A quote has been obtained for the removal of the abandoned
motor vehicle
1.9. A quote has been obtained for from an independent contractor
for the works in default in relation to the garden

Alternative options considered

3.1. A prosecution is not possible because the
owner is deceased and a check with the probate register reveals
that no grant of probate has been made
