To issue a Prohibition Order under Part 1,
sections 20 and 21 of the Housing Act 2004 to remedy category 1 and
2 hazards at 11 Manor Close, Wrafton, Barunton observed at the
property
Reasons for the decision
1.1. The property is unoccupied and requires
extensive renovation. The owner has been placed in a residential
care home by Devon County Council Adult Social Services due to the
condition of the property
1.2. A Housing Health and Safety Rating System (HHSRS) inspection
resulted in the identification of a category 1 hazards in respect
of:
o excess cold
o damp & mould
o electrical hazards
o structural collapse
o falling and personal hygiene
1.3 Category 2 hazards were also identified in respect of:
o domestic hygiene, pests & refuse
o food safety
o entry by intruders
1.4 The proposed requirements of the prohibition order do not
exceed what is necessary to remedy the category hazards.
Alternative options considered
3.1 An improvement notice is not appropriate
because it would not prevent occupation of the property whilst
works are being carried out to remedy the hazards identified.
Because of the health and safety risks to occupiers and visitors,
the property should not be occupied until the hazards identified
are significantly reduced.
