Decision requested by decision maker:
To issue a Prohibition Order under Part 1, section 20 of the
Housing Act 2004 to remedy category 1 hazards at Burleigh House,
Woodlands, Combe Martin observed at the property
Reasons for the decision
1.1. The property is unoccupied and requires
extensive renovation
1.1. A Housing Health and Safety Rating System (HHSRS) inspection
resulted in the identification of a category 1 hazards in respect
of:
o damp & mould
o structural collapse and falling elements
1.2. The proposed requirements of the prohibition order do not
exceed what is necessary to remedy the hazards
Alternative options considered
3.1. An improvement notice is not appropriate,
as an internal assessment of the roof could not be made because
there was not safe access to the upper floors of the property. In
addition, an improvement notice would not prevent occupation of the
property or entry by anyone other than contractors whilst works are
being carried out to remedy hazards. Because of the health and
safety risks to occupiers and visitors, the property should not be
entered or occupied until the hazards identified are significantly
reduced.
