Reasons for the decision
The breach of planning control alleged is
within the last 10 years unauthorised change of use of land to a
mixed-use comprising agriculture, storage use including but not
only the storage of a shipping container, toilet block and
agricultural machinery and equipment, and residential use of the
land, including the siting of two mobile homes for residential
use.
An Enforcement Notice should be issued to remedy the alleged breach
of planning control. The Council considers it expedient to issue
this Notice for the following reasons:
The change of use provides for the siting of 2 unauthorised mobile
homes for residential use in the countryside and associated storage
which have been insitu since 2022 at the earliest and the use of
the site to provide open storage for machinery.

Alternative options considered
The owner has been advised the Council are
issuing an Enforcement Notice for the ongoing breach and there is a
right of appeal against any Notice the Council issues. There has
been no compliance to date despite lengthy time periods given. No
planning application has been submitted to regularise the breaches
either and it is considered the owner is unlikely to comply without
formal action.
