Title of Decison Requested: Legal action to
ensure compliance with Enforcement Notice at Land at Little
Whitstone South Molton Devon EX36 4NH case ref 10290
Reasons for the decision
On 26 June 2024 an Enforcement Notice
(‘the EN’) was issued for the breach that within the
last 10 years the siting of a mobile home as a permanent dwelling
had occurred in breach of Condition 03 of planning permission
reference 56825, which states, “(3) The siting of the mobile
home hereby permitted, shall be
discontinued and the land restored to agricultural use, including
removal of the mobile home, on or before 3 years from the date of
this permission.
Reason: To enable both the applicant and the Authority to
re-assess
the need for an agricultural dwelling in relation to operations on
the
farm holding and maintain long term control over development in
the
countryside.” The EN took effect on 07 August 2024 and gave 9
months for compliance (or by 09 February 2025).
