Decision requested by decision maker: To approve the issue of an
Improvement Notice under Part 1, Section 11 of the Housing Act 2004
to remedy a category 1 hazard at 19 Wilder Road, Ilfracombe.

Reasons for the decision

1. BACKGROUND / REASONS FOR THE DECISION
REQUEST
1.1. A Housing Health and Safety Rating System (HHSRS) inspection
resulted in the identification of a category 1 hazard in respect of
damp and mould growth.
1.2. The proposed requirements of the improvement notice do not
exceed what is necessary to remedy the hazard.
1.3. The owner of the property has been notified that we intend to
serve an improvement notice.

Alternative options considered

It has been decided to take the relevant
action rather than any other kind of enforcement action as an
improvement notice would involve undertaking works to the property.
Once the improvements are completed, it can be expected that the
hazard at the property will be reduced to an acceptable
level.

Other methods of enforcement under the Housing Act 2004 were also
considered and the reasons why these have not been chosen are
outlined on the Section 8 Statement of Reasons issued alongside the
notice.
