To waive the request for waiver and award the
contract to Moffat & Nichol in relation to the Stage 2 Survey
works

Reasons for the decision

Detailed assessment of Rolle & Castle
Quays, Barnstaple to develop a prioritised repair schedule and
associated high level budget cost estimate. These works are to
ensure that NDC can meet the standards set out in the Port &
Marine Facilities Safety Code (PMSC). I can confirm that, despite
non-compliance with the requirements of paragraph 12.1 of the
Contract Procedure Rules the award of this contract to the above
supplier will be best value for the Council for the following
reason(s):
To offer continuity of service and familiarity of the sites
following on from the Stage 1 assessments

I can confirm that I have sought all relevant
procurement advice and consider that it is appropriate that this
requirement be waived for the following reason:
