the Modification Order within its submission to the Secretary of
State.

Reasons for the decision

It is considered that there is sufficient
evidence to conclude that the Definitive Map should be amended by
recording a public footpath along Moorfoot Lane, and no evidence
has been put forward to suggest that on the balance of
probabilities higher rights exist.

Alternative options considered

The possibility of not supporting the
confirmation of the Order, or even opposing the confirmation of the
Order, were alternative stances considered and rejected.
