Purpose
To set out the proposed Compensation Policy
intended for implementation to manage compensation claims, ensure
compliance with legal standards and provide clarity for housing
tenants, leaseholders and officers of North Yorkshire
Council.
A decision is required regarding the adoption and implementation of
the policy.
Decision
That the Executive Member approves the
adoption of the Compensation Policy, and delegates authority to the
Assistant Director of Housing to make minor amendments to the
policy as required by changes in regulation or
legislation.
Reasons for the decision
The report details that a unified Compensation
Policy will ensure fair and consistent handling of claims. It
resolves past inconsistencies, aligns with regulations, and
incorporates tenant feedback, and supports compliance with the
Housing Ombudsman’s Complaint Handling Code and the Regulator
of Social Housing’s Consumer Standards. It aims to improve
service, reduce risks and support accountability.
Alternative options considered
Continuing with previous procedures instead of
adopting a single Compensation Policy was not recommended, as it
would maintain inconsistencies and risk perceptions of unfairness
among tenants. Without a unified approach, staff may apply varying
standards, undermining trust and increasing reputational and legal
risks. A single policy ensures clarity, fairness, and equal
treatment for all residents.
